Terms of Service
1. Purpose and acceptance
- 1.1. Last updated: October 5, 2026. These terms govern the use of YouThumb.ai, a service operated by MIKE MC FORMATIONS LLC, a New Mexico (USA) limited liability company, registered office at 1704 Llano St Ste B-1433, Santa Fe, NM 87505, USA. Contact: support@youthumb.ai.
- 1.2. YouThumb.ai lets you create YouTube thumbnails with artificial intelligence from your prompts, your images and the persons you add. The service is available on the website, through the API and through MCP.
- 1.3. By creating an account or using the service, you accept these terms and our privacy policy. If you do not accept them, do not use the service.
- 1.4. We may change these terms. The new version is published on this page with its date and, for significant changes, we notify you by email before it takes effect. Continuing to use the service afterwards means you accept it.
2. Account, organizations, API and MCP
- 2.1. You provide a valid email address and keep your credentials confidential. You are responsible for what is done from your account.
- 2.2. Your work is organized in organizations. An organization's owner manages its members, roles and subscription; invited members access the organization's content and credits according to their role.
- 2.3. You can create API keys to use YouThumb.ai from your own tools. A key gives access to your account: do not share it, and delete it in Account → API Keys if it may have leaked.
- 2.4. You can authorize AI agents (Claude, ChatGPT, Codex or another MCP client) to act on your behalf. An authorized agent works in the organization chosen when connecting, with its credits, within the rights and daily credit limit you set in Account → MCP. The actions it takes, including generations that use credits, are treated as yours. You can revoke an application at any time from the same place.
3. Credits and subscriptions
- 3.1. Each generation uses credits, deducted from the organization it runs in. Your credit balance and history are available in the app.
- 3.2. Credits come from the organization's plan, which grants a number of credits per period, and from any credit packs purchased.
- 3.3. The price, duration, renewal and content of each plan or pack are shown at the time of purchase. Payments are processed by Stripe; the applicable payment and refund terms are those presented at purchase and in your plan.
- 3.4. You manage or cancel your subscription from the Subscription area of your account. Cancellation takes effect according to the terms of your plan.
4. Acceptable use
- 4.1. Only add a person, and therefore their face, if it is you or if that person has agreed to appear in your thumbnails.
- 4.2. Do not create illegal, hateful, harassing or defamatory content, any sexual content involving a minor, any sexual or degrading content depicting a real person, and do not pass off a generated image as a real scene in order to deceive.
- 4.3. Respect the rights of others: only use images, logos, trademarks and characters you have the right to use.
- 4.4. Do not try to bypass the service's limits (credits, rate limits, MCP rights), access other users' data, disrupt the service or extract its content at scale.
- 4.5. Images are generated with Google Gemini: Google's generative AI usage rules also apply. We may remove content or suspend access that breaks these rules.
5. Your content
- 5.1. You keep ownership of the content you upload (images, photos, prompts) and of the thumbnails you generate, to the extent permitted by the law applicable to AI-generated images.
- 5.2. You allow us to host, process, reproduce and transmit this content to our providers, solely to run the service (storage, generation, display) and for as long as needed.
- 5.3. You confirm that you hold the necessary rights to what you upload, including the consent of the people depicted.
- 5.4. An AI-generated image may contain errors or resemble existing content: check it before publishing. You are responsible for how you use your thumbnails.
- 5.5. You can delete your content from the app at any time. The website, the YouThumb.ai brand and the software remain our property.
6. Availability, liability, termination and governing law
- 6.1. We do our best to keep the service available, but it may be interrupted for maintenance, because of a provider outage or for security reasons. Features may change.
- 6.2. The service is provided as is. To the extent permitted by law, we are not liable for indirect damages or for the consequences of how you use generated images. Nothing in these terms limits the rights the law grants to consumers.
- 6.3. You can stop using the service and ask for your account to be deleted at any time by writing to support@youthumb.ai. We may suspend or close an account that breaches these terms, with notice unless there is an emergency or a legal obligation.
- 6.4. These terms are governed by the laws of the State of New Mexico (USA), without prejudice to the mandatory consumer protection rules of your country of residence. In case of a dispute, we first look for an amicable solution, by writing to support@youthumb.ai. If no agreement is reached, the dispute falls under the courts of Santa Fe County (New Mexico, USA), subject to the rules that protect consumers.
